Introduction

The maintenance of industrial peace and harmony by thetimely intervention and settlement of industrial disputes between the management of industrial establishments and their workers is the main function of the Labour Department Officials. They are also responsible for the enforcement of the various labourlegislations which are designed to confer security of service, ensure better service conditions and promote social security to the workers and the unorganised.

Apart from enforcing the labour laws and the settlement of industrial disputes, the officials of the Labour Department function as quasi judicial officers under labour laws like Workmen's Compensation Act, Payment of Wages Act, Payment of Gratuity Act, Tamilnadu Shops and Establishments Act, Tamilnadu Catering Establishments Act, and Tamilnadu Conferment of Permanent Status Act. The affected workers can file claims under these Acts before the concerned officials of the Labour Department and redress their grievances.

The Department of Labour has also been entrusted with the enforcement of the Legal Metrology Act 2009 and the Tamil Nadu Legal Metrology Enforcement Rules 2011. By enforcing this Act and the Rules the Department of Labour ensures protection for consumers interest & that the public get the exact weight or measure of the quantity they are purchasing.

REGISTRATION PROCESS
Submission of Application
A manual worker may register his name with the Unorganised Board by submitting an application (in duplicate) in the prescribed Form (given in Annexure 1) along with the following documents, to the Labour Officer (Social Security Scheme) of the district in which he is residing.
  1. Proof of Age
  2. Proof Of Address
  3. Employment Certificate and
  4. Bank Account Number (photography of Bank pass Book 1st Page)
Proof of Age
A photo copy of any one of the following certificates, along with the original, may be submitted as proof of age.
  1. Birth Certificate
  2. School Certificate
  3. Driving License
  4. Ration Card
  5. Voters identity card
  6. Original Certificate from a Civil Surgeon of a Government Hospital in the Prescribed format duly signed by the worker.
Address Proof
A Photo copy of any one of the following certificates, along With the original, may be submitted as proof of address.
  1. Birth Certificate
  2. School Certificate
  3. Driving License
  4. Ration Card
  5. Voters identity card
If any Certificates contains both proof of age and proof of address then one Certificate alone may be submitted. It would not be necessary to submit separate certificates for both purposes.
Employment Certificate
Employment Certificate may be issued by any of the persons or officers specified below in the format included in the application form prescribed.
  1. Employer of the worker submitting application for registration.
  2. Registered contractor or Government organization or agencies engaged in building industries (in respect of the Tamil Nadu Construction Workers Welfare Board) where the worker is employed currently.
  3. Any officer not below the rank of an Assistant inspector of Labour in the Labour Department or an officer not below the rank of an Assistant Director in the Directorate of Industrial Safety and Health.
  4. President or general Secretary of a registered trade union of the employment concerned or any other office bearer of the said trade authorized by the said president or General Secretary in Writing in his behalf to the worker who is a member of such a union.
  5. If the Union issues employment certificate in the registration application, the registration number and address of the concerned trade union should be specifiecd along with its official seal.
  6. Village Administrative Officer of the village in which the worker is ordinarily resident and for Chennai District, the Revenue Inspector of the area concerned.

  12. The Maternity Benefit Act, 1961.
  13. The Motor Transport Workers Act, 1961.
  14. The Payment of Bonus Act, 1965.
  15. The Beedi and Cigar Workers (Conditions of Employment) Act, 1966.
  16. The Contract Labour (Regulation and Abolition) Act, 1970.
  17. The Payment of Gratuity Act, 1972.
  18. The Tamil Nadu Labour Welfare Fund Act, 1972.
  19. The Equal Remuneration Act, 1976.
  20. The Sales Promotion Employees (Conditions of Service) Act, 1976.
